Career Ending Operation???

Check with Magoo since he supposedly lives in Tampa.
i have to really think about my new location..i hate hot, mugy days...i hate hurricanes...i hate taxes...

i like "warm" weather, just not the muggies.

when the time comes that i will actually be looking for a retirement area to live, taxes and lack of them, will be among my forst choice of states.

too many old farts move to florida.

not too many seem to move to nevada where there are low to no taxes to speak of.
 
UPDATE: June 17, 2019

just got the call from the surgeons office, i am approved for 12 visits,......only after about 2 months of waiting....
that'll be 2 times a week, for 6 weeks. the doctors script was for 6 to 8 weeks.....

i just called the p/t to hopefully start thursday..i cannot start tomorrow, cuz i have a roofing contractor coming over....life goes on with or with out the w/c insurance company's approvals or denials.
still no word yet on any approval for another set of back x-rays, doctors office w/c person said, that's most likely since my next office visit is not until September.

we still go to court this Wednesday to have the judge (i guess) finalize/approve/whatever, the total disability from the court doctor...the insurance dostor originally said back in July of 2018, that i was totally disabled, but then he back tracked on what he
had said.....hence the court doctor visit.

if the judge approves and my attorney see's no reason why not..that ends the 6 year limit on the claim, and this claim can go on for many more years......i can collect w/c checks, with regular yearly raises, for life......well the life expectancy of the claim which could be 22 more years..........or i can cash out, at a very handsome payment........more on that at a later time.

i am already on SS disability, a different attorney got me on that, first try.....

one more added fun fact, in August (no date set yet) i go in for another surgery, NOT related in any way to this w/c crap i have been going thru.

i also promise NOT to do any updates on that upcoming operation.

this thread was started as a updated log of events for anyone getting hurt on the job and going onto workman's comp.

on how important it is to start a paper trail, and get an attorney that is good in w/c claims, RIGHT AWAY...!

it also illustrates the BS one can go thru with the insurance company, and with out protection from an attorney, how they try to walk all over you, which the attorney will put a stop to that.

many people just give up, i will not give up, hell...it's been 5 years, and 3 months now, and i'm still hanging in there.......

they thought i'd get out sooner...but the more they busted my balls...the MORE i dug in....

never give up..never give in.

i'll update sometime Wednesday on how the court day went.




 
UPDATE: June 19, 2019

ok, so i go to court, get there early...court clerk asked the sheriff to go fetch the 2 lawyers, mine and the insurance one, cuz the judge has to leave at 11:00......my court time was for 10..

mine is about 30 miles away in MA on another case...oh joy...

the insurance lawyer comes in and said we are here for the physical therapy issue......right there i was taken aback. i thought for sure from our last court date, we were there for the disability ruling.....hhmmm........

well my lawyer walks in, plenty of time to spare and we talk a bit at first.

he said too that we were there for p/t but when i sent him an email saying that i was ok'd for p/t the other day, he accidently forgot to tell me to stay home today.

it ain't like i had a bunch of things to do anyways.

my lawyer told me that he and the other lawyer have to go to my doctors office, and the court doctors office for depositions on my disability, which will be used in court in the near future....

still a long road ahead.
 
just got home from my first day back, at physical therapy.

i have the same guy that i have had in the past.

we talked a bit about what i had gone thru this past operation.

he started me off with a few slow excersizes to see what i can do.

of course, too, this guy "gives homework"......!!!

walking is one of the most important things he wants me to do, at least 10 minutes each day.

i already do that and maybe more, when i go to the local walmart, and park my car on the back 40......

there is a junior high school that has a track, i will go there, it's quiet, plenty of parking, and not much chance of getting run over by a blue haired person....
 
just a quickie update, been since mid june, that i have been walking the school track, i (somedays) manage a 1/2 mile walk, but on many other days, i manage a 1 mile walk....i ain;t seeing my belly size go down however.......i sure do hope it's not the constant devil dogs (one a day) or the actual 1 CUP of ice cream i eat, once a day...that's causing my belly not to get slimmer.

any way, with the p/t i am doing, the strecthing of the muscles and nerves, quite a bit of the left foot numbness is slowly subsiding.

the p/t guy told me that nerves do not stretch, but rather "slide" along with the muscels (sp?..spell correct NOT working)

anyway, still more p/t to go last day is 2 weeks away.....

then later in august (if all goes well), i have my foot operation, not w/c related, but very much needed.

that'll start the walking regimen all over again, when i'd be able to.

maybe i ought to stock up on more devil dogs and ice cream..>???
 
UPDATE: July 12, 2019

in another thread (about hobbies) i mentioned something about a pool sand, and that it only comes in a 50 pound pail.

(if i can find 10 pounds worth, i might go for it)

absolutely way too much for me to handle, (the 50 pounds) for a long time, and i suppose NEVER handle myself ever again.

well earlier this week, at the p/t place, the tech gave me a 10 pound dumbell, to walk around the room with....

i do recall my last p/t times, before this last operation, 10 pounds was jotted down as my "safe to carry weight"

now with this recent operation and the further down the back fusion, i'd venture to guess this might be my "standard" weight to handle.

only time will tell, still got about 2 more weeks of p/t left, before this perscription for it runs out.

then sometime in august, i go for my foot operation

anymore back p/t, will be put on hold.

Then there's FRUIT, most of which ain't doing ANY-BODY any good, including "An Apple A Day".
"Sugar Free" Ice Cream doesn't exist unless YOU MAKE YOUR OWN. Sucralose and Aspartame are deadly sweeteners and ADD to Belly, Waist Line, Butt Cheeks, Thighs flab.

UPDATE: August, 1, 2019

today is my last go around p/t.

i HAVE made some improvements over the past 5 years of operations and p/t sessions.

this past Tuesday (July 30th), i had to be "tested" via laptop on my progress.

when i first tested a few weeks ago, my "score" was 40......

the other day, i tested at 48...

not huge improvement, but an improvement none the less.

the p/t co-owner and the secretary both said that when even a little improvement takes place, the insurance companies generally ok MORE p/t as now there is no waste of money.

but even IF there is no improvement in p/t, my doctor STILL ORDERS p/t, and of course, if the insurance refuses, back to court we all go...and guess what.....IT GETS APPROVED....

so the insurance company pays, NO MATTER WHAT....

i have been walking just about every morning, (heat and humidity or rain, NO), but i am walking at least the 10 minutes the p/t tech wants me to do, and that usually amounts to 1 mile each day.

it has been a couple or so weeks now, that i am not feeling much (if any) lower back pains, like i always have since operation #1 with this injury.

i WILL get back pains if i toss and turn at night in bed, and i unconsciencelessly (sp?) over due it while i sleep.

thing now is that the p/t place will order up more p/t, but now my for operation will be coming up soon.

so i suspect the insurance company will deny more p/t, (thier usual M.O.) and off to court we will have to go again, but that may be to my benefit, after the foot operation, and recovery from that, which can be several weeks as well.

only time will tell.

I started a walking routine a few months ago. I leave around 7am and walk the trails for 45 minutes to an hour. It makes me feel good and at 68 years old ya gotta keep moving. I try to walk four days a week.

I walk from my recliner to the frig, many times a day, if I can't get my wife to go for me.
Makes me feel better to not make that long walk.

i still have a rather slow gate as i walk. others "speed walk" past me, or others jog, run...

that's ok, we each have our physical strengths and rhythm.

i do feel good after that mile long walk, maybe in time, it will build up to 2 miles, as i have been "lapped" by the runners and speed walkers...

i am still on w/c and the state paid for health benefits as i have no income according to the rules .



the medicare is for parts A & B... today, i selected an insurance carrier for the drugs portion Part D.

here is the rub, the medicare starts in october, and if i did not select a drug plan now, i'd have to pay a penalty later to get it.

that sucks. i am literally right now, between a rock and a hard place.

still covered by my state's paying into the health/drug insurance, and medicare starting up in october, and no time line yet, as to when this case will settle.

i am not sure i can even have these 2 different coverage's, as i read the website from Medicare some of what they say, just does not apply to me.

only time will tell i guess.

still have other things i have to go thru for my soon to be foot operation. now i must go for an ultra sound on my legs. seems the foot doctor's xray "saw something" that needs to be tested, before he can proceed.

this could very well push back my next appointment with my back surgeon as well...and a possible "final word" on that.

meaning, a possible release from his care, noting that i am totally disabled, then a settlement.

all of which i wish could just happen a little bit faster.

so after a few nights of tossing and turning and getting little to no sleep, all over this health insurance coverage i will need, to supplement my upcoming Medicare, i finally will have coverage that will (along with Medicare) cover me 100%

it'll have medical, hospital, drugs, dental, vision as well.

some of the meds are at $0 as well, some will cost money, BUT if i go for the mail order of just one paid drug?

it'll be for 90 days...$0.....after i pay the first 30 day supply co-pay..!!

0 for my primary doctor to a $25 co-pay for specialists.

just like my current insurance, i'll need a referral....no biggie there.

in a previous posting, i failed to mention that my age also played a big factor, in NOT finding insurance. i am under 65, and as such, just don't qualify for any additional coverage by so many companies i checked out either online or with a phone call....

(not even ANY insurer through the AARP could help me, other than Humana with drug coverage only, which i did enroll with, but that'll be cancelled out by the upcoming insurance i am getting.)

until this morning!!!

i went to the local "blue store", which if you are not familiar with is Blue Cross/Blue Shield...

they had the perfect insurance for me, covers me for all i listed above, plus gives me a $5.00 health fitness membership fee, that all i do is show the place my card (like the YMCA, and a few others on the list), and pay the $%5.00 membership fee.

of course like many other health insurances, there are limits, i can live with that.

but now, maybe when i go off to bed tonight, i can actually fall asleep, knowing that this part of the journey is taken care of.

oh yeah....sorry to mention...the monthly premium for that BC/BS coverage..??

$100.00 per month...

if i HAD BEEN 65 years old.....many coverage's started at $200 and up, and many of those..??

no drug plans.....or VERY high co-pays...

i'll have more info on this, when the paperwork gets to me.
