We have a driver that started October of last year as a new hire off the street. Hes been gone since December of last year with no mention as to why. Magically hes back and it's going on September and hes kept his driver seniority and now has approx 10 drivers below him on the board now. Is there any scenario that you can think of where he legitimately keeps all this? Doesnt seem right to me. Guy works probably 2 months then is gone for 9 months and everyone below him gets shafted

I thought after being off 6 months you lose your seniority.
 
No not injury and not military. Couple of us employees are asking questions. I think in order to qualify for fmla you have to work 1250 hrs in a years time. This guy Is nowhere near that.

I started at FXF with a guy (we'll call him John Doe) on the same day . We started our apprenticeship and finished on the same day.

One day while completing my CBLs the head DDI asks what shift did you get? I told him the shift I got and told him it's because I was dead last. He looked confused and said "no you're not, John Doe is".

He's not the first person to say this to me. The guy that gave us all of our documents while doing dock CBLs told me the same thing.

I went to the manager of operations since he handles bids, to ask him. He said he'd look into it. When I got an updated bid sheet John Doe was still a slot over me. I asked the manager of operations about it and he said he looked into it and the bid sheet is right.

I don't care about it right now because it doesn't matter, right now. But it will matter soon enough.

Do I have any options?

If you both started (with an instructor) on the same day, it would then go to who clocked in 1st, that day.

Beyond that, there are criteria that are absolute, and carved in stone. Not subject to interpretation. Boats post above sounds right. Sorry, I don't know with any certainty what those criteria are. YOUR instructor should contact his boss (DDS - not the Center Manager) to clarify, with an explanation. Do it right away, the other guy would.
