TForce | Fired UPS Freight worker claims religious bias

This can't be true. I know that in Farmingdale when I run there, there is a Rastafarian mechanic, He has his full beard and dreadlocks to his ankles that he keeps up while working. He told me that he was hired after the dress code policy and that when he stated it was his religion, they never bothered him with it again. I doubt the HRS guy is telling the truth since it is the same region as Farmingdale.

Yeah, but with someone different doing the hiring inn HRS. Perhaps that person never looked into the hiring procedure. Beyond the normal appearance policy.
 
But he is a mechanic, I thought the appearance policy only went towards CDL Employees? Road, City, Dock-CDL guys...not the dockworkers or mechanics
 
Playing Devils advocate here, I don't know. Except for religious considerations (Sikhs, Rastafarians, etc), UPS has had it's grooming and dress code "taken to court" time after time after time....and I don't RECALL (which doesn't mean that it hasn't happened, I'll admit) over the last 35-40 years that they ever lost a single time. The courts traditionally have held that companies have a vested interest in the grooming of employees that come into contact with the public in the course of their employment...and even a freight driver is going to have a hard time arguing that his job doesn't at some time or another entail dealing with the public. They've also held to same when it involved safety issues (extremely long hair or earrings, for example, while working around conveyor belts or heavy equipment) In any case, I personally know of a few UPS employees who decided to "test the waters" strongly, so to speak, who's discharges stuck. Don't know any that got money out of UPS over the affair.

Maybe times have changed. And whether past practice at OVNT in that area might hold sway, I can't say. But I'm not sure it's something I'd want to bet my job on.


This is true. Grooming is NOT a contratual issue it is Company Policy. Very difficult to fight and for most is not worth the trouble.

If this gentleman had the hair before, considering it was his religion, it should have been mentioned on the APP. and discussed in the hiring process. I do see liability, maliciousness is better fitting. anyone with any common scence would not hire someone ( without being forth rite of coarse) if a dress code was intentionally going to be broken based on his or her religion.

The person who hired, should be punished , not the person hired, it is against his constitutional rights.

If drivers joined this religion it would seem to me they could invalidate their drug test on the basis of religious freedoms.So how far does the line have to go before you cross it? If you offend customers by the way you look or if your a safety issue from being stoned a company needs some leadway here
 
I really think the bottom line in this whole matter is.
You gotta do what the people want you to do,who are signing your pay checks,or direct depositing your money for the services you are giving them.

If a company requires certain conditions,and you don't care for their terms of employement.
Its not rocket science,don't work for that company,just that simple!

We live in America,and have every right to practise whatever religion we want.
But on the same note,companies can have their own terms of emplyoment,and hold to those standards,in all of their hiring.

If you hire on knowing what the company requires,then try to go against them,you are in violation of misrepresenting yourself when you were hired,which would get you booted out the door,with no recourse on your part.

Now I myself would be known as someone who is very religious,being an Apostolic Born Again Christian,I practise what I hear preached from my church,on a daily basis.

As far as working for UPS Freight the only thing I wouldn't put up with was dishonesty.
However if I ever felt I couldn't be honset working for them,I would have quit,and went someplace else to work.

Well this is some more my 2 cents on this topic.
I think may be up to $0.04 by now.
 
:tongue0002::cuss::Rulz:this week at my barn are tm cut two run to portland or. and told the two driver that they had choice to go to the dock or quit. one driver has 25yr. with the company & other driver as 8 to 9 years too. the tm told them that they can not bump back into the city. they can go to the dock. just yesterday at sat the tm did the same to one of the road driver and he had two people with less time under him that willy sh t !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

We are trying to keep topics on topic. I can understand your anger, I think we all ,to some degree , are feeling this pain, but please stay on topic.

Allthough I can agree with your statement APO. I must say that wether you work for a company that has requirements of any sort or not, one's constitutional right should not be infringed apon, if we allow ones rights to diminish under contract we are not serving the founders of this country with the respect in which our constitution was created .

The whole idea for the Constitution of the United States was to free us of tyranny and opression, two words that are frequently overlooked by society to fit thier needs, ( mostly big business) and in this socialistic society served by both parties as we have seen over the past few months, this has to come to an end.

What we have now in government is not what our forefathers created, the United States of America at this point in history, is more of A embarressment to them ( allthough it is the best country to live on the face of the earth, and I would die for it in a snap, particularly if we were invaded by a foreighn country, or aggressive entity) I believe we should take free enterprise and slap them around a little and teach them what our forefathers wanted.

Then and only then will this country be free. Corperate winbags and greed controll this country and nothing more.

In my opinion this is a very rare case freedom of religion,over big business.
Good for that driver for sticking to his beliefs.
He got a pretty good chunk of money,however how much will his lawyers bill him for?
Also was his job reinstated?
