ABF Freight System intends to press its lawsuit against the Teamsters union in federal court and is not using its filing to pressure the union to negotiate a separate settlement, President and CEO Wesley Kemp said at a press conference Monday.

Industry analysts and industry observers have suggested ABF may be angling for an out-of-court settlement with the Teamsters on wage and benefit concessions. Kemp said no. “The speculation is inaccurate, our intent is to go to court,” he said at the National Industrial Transportation League’s annual meeting in Fort Lauderdale, Fla.

ABF wants a U.S. District Court in Arkansas to strike down three amendments to the National Master Freight Agreement signed by the Teamsters and YRC Worldwide. The less-than-truckload carrier is also seeking $750 million in damages. YRC and the Teamsters have until Nov. 24 to respond to ABF’s lawsuit, Kemp said. ..................

i don't know if abf stands a chance or not on this lawsuit.but there one thing about this why didn't they do this back in the 80s after mason&dixon interstate motor freight leeway ryder redball and most of companys in the boneyard ask for it and got it.I really don't know how it will turn out but if you didn't want stop it in the past but now you want to stop it. i don't see how any judge will let it happen. but there going to hear in one of the most union hateing right to work state there is and yes my state of tennessee is right up there with.i just don't thinks this for the union brother&sister out abf is working to some kind of deal there self.

The difference is that YRCW is not only Not paying the pension but they have also opened up the contract on work rule changes. Those companies you listed and many more just got wage relief.
 
pos hoffa doesn't like anybody telling him no except yrcw. The onion will have to settle out of court because the ABF executive janitor has more money in his wallet then yrc and the onion put together.

If you look at the language in the grievance that was filed,look at articles 26 thru 29,I think they are going by language that was taken out of the 2003-2008 contract and was never put back in..Evidently it was in the prior contracts about separate side deals with companies under the NMFA..I do believe that ABF has a good case but on the other hand what judge would rule against YRCW and put 25000 out of work...

Obviously ABF doesn't. Who's losing 10s upon 10s of millions more per quarter, ABF or yrc?

I may be wrong, but the law is the law and a contract is a contract. If the judge does his job and finds the lawsuit to be credible, what does it matter how many jobs are in jeopardy. I guess this means YRC is above the law and the contracts.

ABF may win ,but in the long run they still lose.

you maybe right abf may win the thing. but it not going to happen with a lower court ruleing one side or the other will take the next step to a higher court and it made make it all the way to the us supreme court before it all said and done with and both sides better have some deep pockets

so what happens to the MOU if this drags out past Jan 1?? Will all LOA memebers have to come back or be off the seniority list?
 
On Tuesday, YRC and its subsidiaries asked that the suit be dismissed, saying that ABF was not a party to the concessions and so lacks standing to challenge the concessions in court. The company’s filing notes that ABF sought similar concessions from the Teamsters this spring — which union members ultimately denied — and YRC wasn’t a party to those negotiations.

“We think the fact pattern is fairly straightforward. ... As they aren’t part of the bargaining unit, they don’t have any right to try and get the same kind of result we got from our negotiations with the Teamsters,” Zollars said at the Wednesday conference. “We would expect that we’d get a favorable result there in a fairly short period of time.”
