As most of you may be aware, we have received a number of grievances from employees who transferred as part of the integration of Yellow and Roadway and were either laid off immediately or have not worked a regular schedule at their new location. In settlement of these grievances, the Company and the union have agreed to the following compromise that has both eligibility and procedural qualifications:

ELIGIBILITY

An employee who transferred as part of the integration is eligible to retreat to the location that he/she bid out of provided:

(1) the employee has not had the opportunity to work 40 hours each week (or the
equivalent thereof for a line driver) for the 4 consecutive weeks between March 15 and
April 11.

(2) the employee's seniority places him/her in an active position at the retreat
location;

(3) we will post a notice at all facilities (that were gainers) the notice will
hang for 10 days and during this period the employees electing to retreat must notify the
company and the union.

PROCEDURE

An employee who elects to retreat:

(1) must notify the terminal manager and local union with jurisdiction at his/her
current location, in writing, of their request to retreat;

(2) will dovetail on the appropriate seniority list at the location to which
he/she retreats based upon his/her present bidding and layoff seniority date;

(3) will forfeit all seniority rights at his/her current location; and

(4) is not entitled to any relocation allowances, the company will not retrive any
moving expense already provided the employee.

If you have any questions, please feel free to contact me or your Regional Labor VP. Thanks, Jack

Nope this one's new to me.. Question is most teamsters left to a gaining terminal and left a losing terminal. Why would they go back? Example 120 to 123... 120 is a ghost town. I believe the teamsters who choose 123 over 135 should have the right to go to 135. Doesn't affect me just thinking it wasn't fair for others, to fall into false hope.

Need to know if this is true!!!

I am on layoff from 218/257 cve/rfo.. I was laid off March 22 and I know I did not go over the hours part of that! And I know people junior to me are not on layoff at 211-Akron; where I transfered from. Can someone please find out if this is a valid memo!!! Fast!!! Please!!!:TR10driving03:

Check your bulletin boards at work, it should be posted. Ask your TM about it. They will try to keep this quiet, there's nothing it it for them. Hope it works out for you.

I haven't heard this but something needs to happen drivers are starving
How will this solve drivers starving? Retreat back and that will knock someone else to the street. Not taking sides just trying to understand.

If anyone knows anything about this decision, let me know and I'll try to get it out in COL(857). Nothing is posted at our barn, I figured that the company and the union would keep this quiet. I don't know if it would help any of our guys but we had several transfer in and then get laid off. I don't think they quailify under the rule about not getting 40 hours in but I'm not sure. That may be why it's not posted in COL.

Here is my delema...not sure if I spelled that right, so take it easy...1) Jenny is my daughters name, so guys dont think I am a chick or something and start emailing me hoping to get some!! 2) if you read my earlier posts you see the situation I am in actually there is more to it! 3) there are junior men working on the dock at 211 where I came from that are not on lay-off 4) 211 is now a cdl only barn...unless you bid a red circle (dock only) postion!! Well, guys have been laid off that had those red circle dock only slots...now what??? do they have to get a CDL or what?? its nuts... I had the opertunity to take a red circle in Copley(211) and past it by to bid the 10% board at 218/257...When I bid that I was told I would have to get Yard qualified in 60 days..well 22 days later they laid me off!!! I am training in the yard now....just have to be yard Qualified; no cdl needed for the yard...Okey guys what would you guys do in my postion????:TR10driving03:
