As most of you may be aware, we have received a number of grievances from employees who transferred as part of the integration of Yellow and Roadway and were either laid off immediately or have not worked a regular schedule at their new location. In settlement of these grievances, the Company and the union have agreed to the following compromise that has both eligibility and procedural qualifications:
ELIGIBILITY
An employee who transferred as part of the integration is eligible to retreat to the location that he/she bid out of provided:
(1) the employee has not had the opportunity to work 40 hours each week (or the
equivalent thereof for a line driver) for the 4 consecutive weeks between March 15 and
April 11.
(2) the employee's seniority places him/her in an active position at the retreat
location;
(3) we will post a notice at all facilities (that were gainers) the notice will
hang for 10 days and during this period the employees electing to retreat must notify the
company and the union.
PROCEDURE
An employee who elects to retreat:
(1) must notify the terminal manager and local union with jurisdiction at his/her
current location, in writing, of their request to retreat;
(2) will dovetail on the appropriate seniority list at the location to which
he/she retreats based upon his/her present bidding and layoff seniority date;
(3) will forfeit all seniority rights at his/her current location; and
(4) is not entitled to any relocation allowances, the company will not retrive any
moving expense already provided the employee.
