Yellow | What is the rule now on LOA?

If you get called back can you do anything to delay that? I'm thinking of taking another LOA or maybe a doctors note to get out of coming back at this time if possible?
 
What Conference are in that still has LOAs? I thought they all expired when YRC was supposed to start paying in to the pension?????
 
There has always been a LOA in the NMFA. the difference is the company never let ya take one to work elswhere. The MOU is what allowed that.....And I am like Jimmy. I think it expired.

I would say that is a posibility.....if the company says its alright. They were given out few and far between, and I never seeen it at RDWY. The other thing was that pension and H/W were supposed to be paid by you before ya went on leave. I "heard at some" Locals that requirement was waved. I personally don't know of anyone that pulled it off, it was just more language that did'nt seem to apply to anyone. FMLA could be classed as fraud. And like the man said, your BA may be more help than us.
 
I think you have to have worked 1,250 hours in the preceding 12 months to be eligible for FMLA. Probably wouldn't be an option for a lot of those called back.

Called my steward. He doesn't know. I called Central States a while back and they said that 1 year is 1 year of vesting regardless, but my steward said they just sent out some letter stating that 2 year break in service means you lose all your pension credit? Does anyone know what the deal is?

My thinking is to take the article 43 provision stating I can take a 90 leave of absence if I get approval from the company and union(will I get that?) and it also requires you to pay into the health and pension fund BEFORE you take this leave of absence. Does that mean I will earn the 67 (13 weeks is like 65 days credit at 5 days a week for 90 days)days necessary to have 5 years credit in the Central States Pension fund? I only have 4 years credit now or maybe none at all if the 2 year break in service rule is true. Does anyone know more than I?
 
Many of us Indy/City resigned rather than report. I had 10 years Yellow out of 22 in the Teamsters. One had 19 years with Yellow; quit to work at the company I drive for now. I wasn't allowed a LOA; his ran out.

I figured out what the deal was the other day.

a. You lose your pension credits if you are separated from YRC for more years than you have credits and are not vested. My years paid in are 4 years on April 2009 so I have 4 years to get back to work and not lose my credits even though there is a 10 year recall. Seems stupid to me?

b. The LOA is possible in the southern conference. You pay your health and welfare and pension at 25%. It is guaranteed to be granted my BA said. Sounds like a sweet deal to me. Don't have to work for YRC and get vested anyways. Guess the only kicker is you can't drive a truck or whatever jobs they forbid you from having.

Your previous post about losing your pension when you are gone 2 years scared me enough to call the Hall. They're sending me a printout of my pension.

When I was laid off in 2008, I had a letter telling me that at age 62 I would be eligible for 2488 @ month. Then later I received another letter a year later saying I would be eligible for 2488 @ month at age 65.

Right before calling the Hall, a friend of mine called that they had reduced his already drawing pension be 250 @ month (He retired last Oct at age 57.) Anyway, the Hall tells me that I got out just ahead of the YRC fiasco (Laid off Yellow, called back in a letter from Roadway to report to YRC in March, 2009, and I resigned rather than report) and that I am still on course for 2488 at age 62, per the Hall. Which is fine; I have a great job now, great Health, and the SSI tells me to wait til I'm 66 for the best effect. (I'm 57 now, with 21 (per the Hall; 22 on the letter I have) paid in.....

Confusing Enough???????
