Yellow | No Pay for my Vacation???

I went on vacation and put in for my pay. I received a letter with the following explanation for getting no pay.

"there is a request to pay Mr. -_________ one week of vacation from 3-22-12 to 3-28-12 with the w/e 3-17 payroll. Even though he qualified during the anniversary period of 10/23/01 -10/15/11 as a sleeper driver the calculation is based off of 2010 earnings which were zero(12-26-09-12-018-10) I just wanted to notify you of this before next Thursday."

So, because I was laid off and had no pay to base the earnings on they can pay me nothing for my vacation? I am going to file a grievance but I am unsure what to put, any help??
 
That sounds more like an April Fool's joke than a factual explanation. If not for being a hardship on a worker it's even funny. I remember a guy getting a paycheck for $0.00 once. He was off sick for the week with no sick time available. Your case rivals that. Sorry but I am not able to help you out there. Hope you get it solved quickly, no one can do without a check these days.
 
Your vacation pat is based on 1/52 of your previous years wages. If you didn't work in 2010 you have no wages to base your vacation on .

That scenario would be correct in Western States.

If there is no 1/52 of annual wages on which to base vacation pay, your "vacation pay" would be $0. (anniversary date to anniversary date)

You are entitled, by contract, to your "vacation time."

Some at our barn are experiencing the very same dilemma.

You are entitled to your (2) personal holidays as of this past Sunday and your sick days as of January 1, 2012.
 
Being a city driver your road language is foreign to me. We have language that details how many days we have to work in the previous year to qualify for vacation or pro-rated vacation for the period in question. At any rate we do have to work a minimum number of days to qualify for any vacation at all.
 
File under Article 56 Section 10. Your argument is the language does NOT require you to have earnings with YRC. Attact a copy of your W-2 for the year in question and hope your panel is sympathetic. GOOD LUCK!
 
Did you receive unemployment for that year you were off. And was it paid into by yrc. That might be an angle to try for some wages. YOUR BROTHER ALWAYS!
 
Don't understand why anybody would want to go on vacation from these companies...gotta move that freight keep doors open 10-4
 
You can just take your vacation time as you move to follow your work.that way the mileage pay for moving.will look like you got vacation pay..

I always put in for my vacation pay 3 weeks before my vacation so that I would have the vacation pay in my hand before I went on vacation. I never encountered the problem you have,but now I`m glad I did it the way I did. You need to contact your BA to get this matter looked into. Just doesn`t sound right to me,but I guess stranger things have happened.
 
Vacation "pay" in Central States has always had the requirement that one work 60% of the year or the "pay" would be prorated. City....156 days was 60%. I had assumed that the Road was figured on "tours" instead of days. If he did not work during his Qualifying period ( for CS it was from Seniority date to Seniority date) I would say there is no pay earned
 
How would a new employee's vacation be figured? We had several roadies run into weird vacation stuff after only working partial years and not getting their full tours in, all of them got some kind of prorated amount. That stinks if you get nothing but unpaid time off that noone needs.

You get paid "in lieu of" benefits. Only $$, no insurance, no pension.
 
Well if he did not have the trips for vacation then why did the company give him the time off? There is way to many questions on this matter. YOUR BROTHER ALWAYS!
 
All of you need to read Article 56 Section 10. Weekly vacation pay is 1/52 of the previous CALENDER year's earnings for sleeper team drivers. I don't see anything in there requiring those earning coming from YRC. Once he has exhausted his remedies through the collective bargaining agreement he then can peruse legal action through the DOL.

Obviously YRCF is not disputing the vacation. ONLY the pay. If I read his post correctly it appears he did work for YRC in 2010. Also the contract states PREVIOUS CALENDER YEAR. This IS 2012, that would make 2011 the previous year.
 
Hey man, it would really help us figure it out if we knew what conference your in. I ran into this as a non sleeper road driver in central conference. There is or was (only been year & a half ago) that did provide me with a full weeks vacations but only something like 350 per week. Sorry don't have time to look it up but I was able to get that much out of them, good luck. when time permits if you have not got answer will look up for you.
