Article 38 is standard contract language. It makes sense. We are under a contract for 5 years. Having a wild cat strike over every decision employees disagree with would be *******. We have the right to strike when the 5 year contract is up and there is not a new contract in place. We could strike by taking a strike vote and voting to strike if no agreement is done by a certain date. Or we could vote no & have them go back and negotiate a decent contract and if it isn't decent then we vote to strike. The first step IMO is to throw this back at them and tell them to do it right. Then they will know we have backbone. That's something management thinks we lack. Or else this crap would not be sent to us for a vote. It's an insulting offer.
 
That Article 38 is ironic. In the NMFA there is a similar article, it is typical language but ours allows for a strike if the company refuses to comply with a grievance decision. That allowance for such a strike was given up by Ron Carey back in 1994 and Hoffa got it back since then and he made a big deal about it like it was a huge win. "We got the hammer back", he proclaimed, puffing his chest out, smiling from ear to ear and strutting back and forth at his podium. I do not know of any situation where it was used.

I don't know of it ever being used either ABFer. I think one time years ago, in a company long out of business, a strike threat was made concerning paying monies owed on a grievance. The only strike I was involved in concerned card check. Was with a company that worked during the 1994(?) strike. Yes it was a Teamster job.
