The judge appeared on Fox Business Network’s “
Mornings with Maria,” where he said the email in question was from Clinton aide Huma Abedin to the then-Secretary of State and her inner circle. It said they were hacked and that technology staffers were temporarily disabling State Department security features to accommodate Clinton’s private server.
Napolitano says that disclosure contradicted Clinton’s claim of never jeopardizing national security secrets or the fact that she claimed her emails were never hacked.
He also said Clinton’s credibility regarding the fact that she had released all of her work-related emails was at stake, adding that U.S. District Court Judge Emmet Sullivan asked that Clinton swear “under penalty of perjury” that she handed over all her governmental emails to the State Department.
“That is a code phrase for ‘I think you’re lying to me,’” Napolitano said.
Clinton said she deleted the email before the formal request to turn over any emails were made.
Clinton’s failure to give up this email could add perjury to her case, Napolitano said, which could lead to her indictment for espionage, conspiracy and the obstruction of justice.
