Does it seem right that while I was driving a linehaul down to Chicago I was hit by a drunk driver and broke my neck, I called a few months later and asked if I was still ahead of the drivers below me in senority. There answer was from the time of my accident my senority was frozen so anyone after me would leap over me and I would be on the low end and my pay and benefits stoped at that time. They indicated once I returned the clock will start up again. Does this seem right to anyone? I do not understand I was almost killed in the line of duty why should I get penalized?

This sounds like the canned response from one of the SERTs...and they aren't the sharpest pencils in the box.

Talk to your RM...don't get a reasonable response?...then call Ann Arbor...keep going until you get an explanation.

I know of two people who were off for months...one just days short of a year and they both kept their seniority...it wasn't frozen.

Times have changed...things may be different now.

Just doesn't sound right.

Sounds like a new driver to me , he didn't say. You can take your pen and your can and shove it.

I'm not a SERT,got it?

I wasn't talking about you...I was referring to the phone call the poster made and the response he/she recieved as to their seniority being frozen. You misunderstood my response.

I never inferred nor meant to imply you were a SERT.

I would also check with your state workers compensation division. In MOST statesyou are entitled to all benefits while on WC just as if you were working including SENIORITY, VACATION, HOLIDAYS ECT. Good luck to you driver and I hope your recovery is going well.
