The difference between At-Will Employment (currently @ NCT) and a Teamster
contract
This past Friday local driver J C was suspended for 3 days without
pay. Yes, an income loss of 3 days! This happened just because the boss said so.
The boss decided that J C was guilty with no day in court. Again, as American
citizens we are innocent until proven guilty not guilty because some law
enforcement official said we were guilty. So, why should we not have the same
rights and freedoms that we enjoy as American citizens in our place of
employment?
The At-Will employment doctrine says that you can be fired for any reason at
all, even if it is not a good reason. Just because the boss said so! Under this,
and proven by NCT management on Friday as well as many other days, you can be a
great employee, make the company money, show up to work on time and every day,
but still lose money that your family needs to survive because the boss said you
were GUILTY! Can your family take that chance in this economy or any economy?
Under a Teamster contract with Just Cause this is what would have happened. The
employer could only discipline within the guidelines of the negotiated contract.
If this situation called for a verbal warning or written warning then the
employer could give that discipline. But if the employer tried to suspend or go
outside the contract then a grievance would be filed and the discipline would
have to pass the tests of just cause in order to be "just cause". So, J C would
have not lost any pay and he would have his right to innocent until proven
guilty.
Discipline, Suspension & Discharge need to pass the Seven Tests of Just Cause in
order to be deemed "Just Cause"
If the employer reacted to J C or any employee in the same fashion the employer
must prove Guilt under the following rules:

So, the choice for your family should be easy. The approximate 3 hours a month
in dues gives you and your family insurance against "just because the boss said
so".
