any body filed a grievance against roadway for breaking the 10 hour rule in the contract? how did it go and whats involved?
 
:chairshot: In the central region they will dispatch us out if we return before our 10 is up...... an example would be return after 9 hours and 50 min. Get dispatch on a 2.5 hour run. End up with 12-13 hours that day.


Another example is dispatching you out on your way back to the terminal even tho` your 10 is up once you get back then they tell you "We don`t have anyone else to do it"

Like a good little employee I bend over and say " Yes sir...... may I have another! :butt kiss:
 
here we hit the dock after our 10 and work outbound and then switch. usually turns into a 12 to 14 hour day I thought somewhere in the contract it said we were not compelled to work over 10 hours or 2 hours overtime max. when I bring it up however they look at me like Im crazy
 
here if you let the dispatch know you got to be off on your 8 before you punch in you are granted off on your 8's. If not they can hold you for 10. After the ten you are not obligated unless you are on an unassigned bid or working while on lay off.

File any ways and contact your BA to entertain your issue thats what hes paid for. Don't know for sure about the Carolina supplement brother but check the book find the article and if its a violation run with it.
 
o-k I have a unassigned bid so how does that effect the rule specifically? If we consistently worked only 8 -10 hours then there would be a need for more employees less chance of a layoff. of course there are brothers whom are working 12+ plus every day and they seem to like it, however they do not get laid off either

Hello Eaglescout. I don't know about your supplement, but the Southern Region Supplement has specific guidelines for overtime and how it is to be counted if there are employees laidoff (Article 42 Seniority, Section,1). Depending on the number of hours of overtime worked and the number of employees worked daily, the employer is required to count one day towards working a laidoff employee back on regular if there are more than eight excessive hours of overtime. The formula is explained in this Article and section but like I said, your supplement may be different.
 
Refusing to work can get you fired. Go back out if they are requestion you to. When you can check with your steward and or BA.

Unassigned employees will not be forced to work after completing their forty (40) hour guarantee, including holiday pay, provided they give the Employer written notice no later than the beginning of his/her workweek.

my point being I thought there was language in the contract that stated no employee would be forced to work over 10 hours. I can not seem to find that in the contract anybody no what article and section that is?
 
in the southern contract we have excessive overtime provision in the event of a layoff.to the best of my knowledge their is nothing in the master pertaining to excessive overtime.in my previous dealings with the greenville,sc contract their is not even a supplement to the forcrd overtime during layoffs
 
Eaglescout your azz is big R's for 10 after that you can leave,, Unless you'er driven in the city and you are still out when you hit 10.What I mean is you cannot come back to the yard just because you hit your 10 hrs You have to finish your assignment.. But once you hit the yard the choice is yours.. I belong to local 509.. Work in Greenville, S.C. Hope this helps......
 
Oh yea as far as what bid you work.. It does'nt matter.. 10 is 10..Don't let them jerk you around.. Trust me your sups are like ours They want you to think they know the contract but we all know thats a joke...10 and home will keep the layoff reaper away...
 
Stay on them eaglescout. I work in NC as a city driver and had this argument with the tm alot. Now they know that when they bring me back to the yard and I have 10 in thats all she wrote. I will drop my unit out and go in to dispatch and my card is waiting. If the dock guys are real bad covered up I will drop a few out for them sometimes if they ask me. But it all depends on how tired I am. Management knows they cant keep you if you want to go. I will get the article it is under for you if you want. I am suprised docksteward in 671 hasnt gotten in on this one. If people hold them to 10 they have to bring back men or the freight sits.
 
thats what I thought the 6 weeks before I was laid off I was pushing 59 hours and then I walk in on Friday and get the letter. all respect to our steward but this is something that he does not seem to want to bring up as a issue (grievance) maybe because he works 12 hours every day? I have discussed it with the ds and he does not want to press the issue so I think I will file the grievance myself. I have no interest in working more than 50 hours a week. All that overtime just goes to uncle sam anyway. I was told that since we are combo drivers on the bottom we were required to stay and finish closing up. ba says they need to hire casuals to help
 
eaglescout, what you are looking for in the contract is in the carolina supplement (blue section) article 59 section12 page 190. The first sentence says it all, no questions about it. If you close up and do not want to work past ten then I would tell them and give them a little time to get a caual hired or something. But set a dedline, and when the time comes go to them about 15 min. before your ten is up and ask your dispatcher if he wants you to seal the trailers or leave them open for the inbound guys to finish. You fulfilled your obligation to big r whenyou gave them 2 hours overtime. Hope this helps you guys out.
 
Thanks I thought I had read that now the fight with management to get off at 10 begins. this has never been pressed at 688 since the brothers feel hat working 12 hours is acceptable. just call me troublemaker
 
Eaglescout patience is a very good tool for any dispute with management,before reacting to words of encouragement from others be sure that you are protected by the contract (i.e.article and section number)file the grievance first before leaving.Management can fire you for walking off the job,it will be hard for the local to get your job back if their is not a clear violaton of the contract.As in any dispute a resolution is not usually one sided.be prepared for lost wages that may never be recovered/
 
yeah eaglescout, i have been called that alot around my barn too. I quit worrying about the drivers who willingly broke the contract around here. Now when they ask me about a contract issue when they get shafted i just tell them to go to their good tm buddy that he is their friend. We (me and management) have a better relationship now they leave me alone and i could care less about what they do to the rest of them.
