The fact that some chosen employees were notified in advance of the closing does in fact shore up the lawsuit regarding the WARN ACT. I was told by a prominent lawyer who deals with labor disputes that if only 1 employee was notified prior to the closing it is in direct violation of the WARN ACT both on the state level but more importantly on a federal level. Those employees who willfully chose to not reveal the information to other employees are subject to federal criminal fraud charges, and that's just the tip of the iceberg. I think at some point we can understand that it was every man for themselves,but you can't break the law in doing so. I hope they all get good lawyers because they're gonna need them.
