FM.....the long and short of it is, there ain't a damn thing you can do about it. The very best thing you can do is to drive on......the very worst you can do is to let this idiot get under your skin.....then he wins. FM, you're a good guy and most of us around here know it. To the larger questions:

Yes, it will go in your file......nothing you can do about it, so don't stress over it.

No, you won't get fired over the allegations of one individual or even several undocumented, unproven events. The films and all that other jazz are in case you really were a bad guy and your behavior did cause a bad accident, the company could prove that they were doing their best to straighten you out.....its a lawyer's game.

Yes, you will be followed (actually twice) in the next 45-60 days. But I'm sure you're like me and if they had nothing better to do than to follow me from now until the end of time, then all I would have to say is, 'saddle up'.

Yes, if you beat the crap out of this guy when you are off duty, it is very, very likely you would be terminated......policys against violence in the workplace extend to outside of the workplace if it can be shown that it was an effort to intimidate, harass, or injure another employee based on altercations that occured at the workplace.

Lastly, I believe that you stated that this individual actually threatened you in front if your SCM. The next time that happens, immediately tell whomever is there that you feel as though you are working in a threatening enviornment and ask what is to be done about it. If nothing is done, immediately document and call HR. Trust me, it will be addressed and the stuff will stop. Also, I get the feeling that this guy is only a very short distance from going over the edge.....gently help him in his journey.

i have another question.

what if fm was hanging out in a bar or walking his dog or whatever not on the clock not on company property not wearing a uniform and he decide to beat the **** out of the other guy can he lose his job for that?

Well, besides possibly going to jail and having a lawsuit, yes I think they can fire you if they think a work place incident carried on to after work.

No, sorry if I didn't make it clear, the verbal threat actually came from another driver about a unrelated incident, (he was mad that I passed him, go figure) and was in front of a supervisor at the center I run in to. The supervisor made a statement that he doesn't remember all that was said, just something about the shoulder, from what I was told the other driver did get a 3 day suspension for it, and then he told them if they were giving him 3 days then he wouldn't be in Friday either or so I was told, however he was off those 4 days...

FM, The only thing I can tell you for any satisfaction is that you DO have the right to place in YOUR file a protest or a complaint about this problem to be sure your side of the story is covered. Type up your side of the story and march into the CCM.s office and make a formal request to put that in your file. Make a note of the date, keep a EXACT copy for your self. If this comes down to it it might be the only thing that saves you.

I would also take a friend in with me when I made the request. (Maybe even
stay to watch him put it in the file), if your part is not in there at some later date, someone will be in trouble for that too.

Putting your side of things in your file is a great idea. Make sure he knows you have a copy and your witness is there to make sure it gets in the file.

Our SCM won't allow anyone to be a "witness" when he's berating employees.
 
Had a chat with the CCM and HR guy yesterday, they said that the driver was embarrassed, the story is that he told his wife he didn't really want to report a fellow driver so she called in using a false name so he wouldn't know she did it, then he also decided to report it. That's their story anyways.

They said that it will remain in my file that there was a motorist call in.

The ticket that was amended will also remain.

As far as I know the only thing that happened to the reportee was that he said he was embarrassed by his wife getting caught in a lie.

They said that disciplinary items will be handled differently and not in front of everyone in dispatch and they were sorry it was handled that way to begin with.

even though it was found out to be a lie, you will still have the items left in your file. Did they explain their twisted logic in reaching this decision?

And nothing, nothing will happen to this *** of a driver? I believe in Karma, I also believe in giving her a helping hand.

This is what managment thinks of the employees. "Yeah, we know it's a lie, but we're going to make you pay for it anyway."

One thing about forums is that you can say or deny anything without proof. I am not saying that anything said in this thread is not true but I have some questions about certain things.

First with FedEx facing millions and possibly billions of dollars in law suits do you think that that would let anything be put in a personal file of an employee that could come back to haunt them.

Second anything that goes in your file is scrutinized by auditors and originals sent to HR so false allegations or lies would quickly be removed.

Third legal advisors are now part of HR, they would not allow hear say evidence put in your file because hear say evidence would be quickly thrown out of court.

If a CCM is doing this I would not surprised to see him or her removed or what could be the case the CCM just may be saying this to act big, either way I doubt very seriously that anything that is not fact is in a personal file.

Not good enough for me. The call was made with false statements and an agenda. The Information given was false and given to get another driver introuble. All files on this call should be deleted and the driver with an agenda should be TERMINATED!!
 
Go to the top,they are guning for you,we had some what of the same stuff at my barn,people trying to get people fired or in trouble,AND they do not have the right to put that in your file..When a coworker and his wife are making false staments, and you prove it they should go after him..And would tell your CM and HR if they dont you are going to call someone hire up in the company till this is fixed the right way...
 
sounds to me like a bunch of bull spit.

go in the drivers room on the wall is a poster that says alert line call it tell them your story.the hr guy you spoke to go above his head too.a squeaky wheel gets the greasing don't back down don't let it just go away because next time it could be your job.
