LTL carrier asks appellate court to hear legal challenge in trucking battle

ABF Freight System is taking its legal challenge against concession agreements negotiated by YRC Worldwide and the Teamsters to the U.S. Court of Appeals.

The less-than-truckload carrier filed an appeal of the Dec. 20 district court decision dismissing its case against its competitor with the appellate court in St. Louis.

"ABF respectfully disagrees with the court's decision last month," the company said in a statement. "Therefore, we have chosen to exercise our right to file an appeal."

It was ABF's first statement since U.S. District Judge Susan Webber Wright ruled after a hearing that ABF did not have jurisdiction to sue over the agreements. .............

And when that happens....ABF is going to force you to pay for the funeral and all of it's orphans left behind after the funeral!..They will be able to get around the vote by being the only survior in the NMFA....be cafefull what you wish for!....KK
