D.O.T. rules are law, yellows rules are subject to interpretation by our union. Your 14 hour day can not be extended by any off duty time Period.


YOU CANNOT DRIVE AFTER 14 HR"S ON DUTY PERIOD.
Your 1 hour lunch break and 2 - 15 min breaks count towards 14 hours but do not count in calculating 60 hr. week!

EX: punch in @ 8am take 1hr lunch and 2- 15min breaks punch out 10 pm =14 hrs. for the day PERIOD.
BUT on the white card recap it only = 12 and 1/2 hours subtract that from 60 and you still have 47 and 1/2 hrs available

You can go past 14 hrs on duty as long as you do not drive after your 14th hr. All time past 14 hr counts toward 60 and you must explain all hrs in excess of 14/60 ie: worked dock , paper work, physical, drug test, transported back to terminal by another employee, taxicab etc.

I really don't think any Yellow drivers have problems with the math......but I have seen some that went over on the 14 hour rule because of lack of testicular fortitude.

so true, its either that or they can't make enough money even with a great union job. Just think what they would have to do if they were only making .38 cents a mile!!!!
 
about 14 yrs ago we had a disp. in harrisburg' pa told me the load was going to be a while I can go off duty till it's ready. can I use the bobtail to get dinner I said. (yes) he said. I drove to my brother in laws house sat and chatted for 1.5hrs. got dinner on the way back took my good old time. around 2.5 hrs later I came back he had a fit. I told him I was releved of duty. he couldn't do a thing and payed me my time . that was the last time he ever did that again.
 
I think there are some drivers that don't understand you CAN legally log over 14 consecutive hours on duty. Example: You show up for dispatch, Your load is in the shop for a light problem, and you are having your brakes worked on. (Must be logged On duty not driving according to DOT) 5 hours later your ready to go. You drive 9 hours and you blow a tire. Now your on the side of the road for 4 hours due to the breakdown. You can't drive but you still have to log on duty not driving until they send someone to drive your truck on into the terminal. (Total hours legally on duty 18) You just cannot drive past 14th hour. I have also verified with Kansas DOT officer.

Yup! And darn good thing you blew the tire when you did or you would have been in violation. And then you have to take extra time off because you went over 14. Guess if we need to we can make rocket science out of it. :annoyed: Heck what the guys stuck in a snow storm for 3 days without a sleeper gonna log? And then what did the guys do when Katrina hit and shut down the refineries and there was an emergency on fuel deliveries? And if I get in a wreak will waiting for the fire department to cut me out be on duty not driving or am I ROD'd? And if it happened in a sleeper could I log it in the bunk? Any body got any more senarios to confuse me with? :shutup2: I have never been a drunk but I'm about to start :knockout: Not ment to be an insult Ykfmc but as you can see the Government never nails anything down and if all else fails---Hell just write the ticket and let the driver fight it in court. :smilie_132: The intent has always been after being up for 14 hours you go to bed. In the 10 hours your off they hope you sleep for 8 the doctor hopes you eat right and I hope you shower and shave.

I agree, I just never new it was legal to log past the 14th hour but it is. Now I know what all the fuss was about the new HOS rules changes. Its bull we report for duty and if we log legal to protect ourselves it still hurts our pocket. What cracks me up is when yellow tells us to go find a mty sleeper and go to sleep to save our hours. Yellow wants it both ways. Follow DOT but lie on your log to book. They cant have it both ways. We got to protect our hide. We have a driver that is still in court. the supenned the last three years logs due to a fatality. Hope it works out.
 
Man that sucks and I'll bet a weeks paycheck if they find any irregularities in his logs, Yrc will say we never, ever, never asked anyone to do anything shadey on their logs :toxic: Hope it works out for that driver cuz he's on his own now. Man that sucks :hide:
 
I agree, and your example is 99% correct, except I would have been in a hotel parking the truck at 8 3/4 hours doing my post trip inspect and paperwork, before that tire blu at 14 hours.
 
Everyone has a problem with the hours of service. The one thing you have to know is that the key word here is the word DRIVE. You cannot DRIVE after being on duty 14 hours! You cannot DRIVE after being behind the wheel and in contol of the vehicle for 11 hours! If you are close to being in violation of the hours of service, I recommend you call dispatch to assist you in some way (directions to a motel) or if you are on the side of the road, call the state police for an escort to a safe place. (They can document your logs) I've done this before!
