If a driver was let go, and 3 months later gets reinstated because a speeding ticket was dropped. Does he keep his spot on the board?

He should keep his seniority. They shouldn't have let him go until the ticket was dealt with, someone in HR and safety had a hard on to fire someone.
 
Was not his first ticket and had a accident then was let go, now he found out the one ticket was dropped and they are going to allow him to come back. He just don't know if he will keep his spot.

Back in the day,if you were busted for DWI,and a lawyer got you out of it,you were good.

Now,if you are busted fir DWI,that's a wrap on your fedex job. No exceptions.

Not sure how that would apply to your situation.
 
Kindly remember folks that as soon as the ticket enters the system, FMCSA is notified of all the particulars,and the ticket goes on your federal driving record, and your employer is notified of the ticket. This typically takes 72 -96 hours. I know a driver who "forget" to notify the company...and the fuel tank on his tractor is very highly polished now.
 
So, if it is a BS ticket and you prevail in court, you're still guilty in the eyes of the Feds and the Fred?

RC, to answer your question, according to Anne Ferro, Administrator of the FMCSA...there is no such thing as a BS ticket. The only way to remove a ticket from your federal record is rather onerous. After you beat the ticket in court, you have to get a lawyer, go to federal court and get a federal judge to order the FMCSA to remove the ticket from your CSA score. Even then, Anne Ferro has been qouted to the effect that they're not required to actually obey the judges orders, so the ticket may well remain on your record. We have a driver in my barn fighting this right now. He beat a ticket in California court, and he's trying to get it removed from his score.

Stop the misinformation. The only thing that shows up on your CSA score (they don't even track us individually yet) is an infraction incurred during a DOT reported inspection. If you didn't get an 8 1/2X11 sheet of paper that says you're required to submit it to your company, it's not on the CSA. Speeding tickets, by themselves, don't count toward your CSA.

There is no "federal" record being kept for tickets and the like, it's still state level. You can still beat CDL tickets too. It just takes more money.
