I must be missing something here. When freight is damaged while being shipped by a freightline, the carrier is responsible for the freight & damages. As I remember the ship had owners from one country but was 'Flagged' by a company in another country. Every owner, lessor or those involved in making a profit from shipping should be liable for damages. I don't know which insurance company wrote the policy, I assume the shipping company(s) are self insured up to a set amount then the insurance carrier is responsible from that point.
I don't always agree with the ambulance chasing law firms but a local attorney said that when there is an accident everybody is sorry but nobody wants to accept the liability & pay those who are injured.
