heyseed, the contract HAS TO HAVE the same wording as the proposal if you agreed to the proposal. Now, did you agree to the proposal?
 
Here's what the NMFA reads..........


(10) Unless otherwise agreed to in any Supplemental Agreement, the following will apply:
Supplemental casuals may be used to supplement the regular work force (dock only) and shall be subject to a four (4) hour guarantee when called to work. Four (4) hour casuals shall be started on an established starting time; or when called to work at a time other than an established starting time, must end his/her shift at the conclusion of that established starting time shift. Four (4) hour casuals shall be eligible for pension and/or health welfare contributions in accordance with the applicable supplemental agreement.

That is true, but can't the same casual working as a driver, won't he just get paid whatever the casual driver rate and guarantee is in that particular supplement?
 
At 342, we have always been a driver/dock combo barn, and have a different rate of pay for casual drivers or casual dock workers and different hour guarantee, (6 hour). They currently call a casual for whatever they need, allthough they haven't needed driver casuals for quite a while, since we have 20 plus on soft layoff who do come in.
 
Hey hilo............671 is about the same. We've had 4 hour guarantee for the casuals for 20 years. The last two contracts froze the casual pay at $16 per hour. The new contract calls for $14 pay on all new hire (after April 1, 2008).

671 hasn't worked casuals in awhile, they would rather keep guys in layoff and work everyone 10 hour days and offer 6+7 punches, 3-4 days a week.

Let's see........work a casual @ $14-$16 per hour or force me to work OT at $34.07 or $45.02!?! DS.
 
We have the same driver/dock combo barn. If a 4 hour casual does perform work in the yard and is CDL qual he will be paid for any time at a different rate in the yard. It is up to that casual to ensure the time is put on his time card by the supe to be paid for that work at the prevailing rate for them.

Well..........the complaint was based on a memo from the IBT explaining the $14 casual. Here's what the memo reads in part....

$14 CASUALS
In the event a company recalls all workers on layoff and first works casuals employed prior to April 1, 2008, it may ultimately utilize some four-hour, $14 per hour dock casuals. In all likelihood, the four-hour casual will not be used until the competitiveness of the NMFA carriers improves. In addition, four-hour casuals are eligible for all benefit contributions according to the applicable supplemental agreement.


However, Article 3 of the new NMFA says this.......

we have been using four casuals on the street for a month some working ten eleven hrs eight guys still on layoff local ba says they can do it theese are fourteen dollar men is there any way to have this meester not teamster investigated by the national he is supposed to represent us not the company his favorite saying is u cant tell the co how to run the business sounds like he is representing them instead of us
 
go 4 it i would go over his head im sure he is not top dog at your local .if he is then im sure some 1 here can hook you up with the # for the international . but dont be surprised if there was a deal made locally letting the company do it . they sold us all out on the contract why should they stop now
 
our tm wants twenty of theese on the street if not stopped this will spread like wildfire to your terminal but it seems like nobody cares until its to late i thought union officials took an oath and if that oath is broken cant he be removed he is playing us for a fool ineed a number to call to put the heat on him to do his job

I hope by now everyone is starting to realize that this coo and contract is the the slow death of the freight division in the teamsters......if something isn't done immediately, none of us will be around to see another contract....for you guys up north at 123, good luck!! you are the guinea pigs for this test.....as stroud 120 has been warning you, it's gonna get all bad real quick for you.....:red_bandana:
