Anybody with a CDL is held to a higher standard. Even in this case lawyers will try to shakedown the commercial vehicle owner/driver. Usually a company will settle on a payment to the at fault vehicle driver just to avoid taking a chance in court.

And the lawyers will also put the truck driver at 25-30 percent at fault just for being there, for when they agree on a settlement...
 
I know as a UPS Freight Safety Trainer, I learned that if a professional driver is involved in a crash.
Regardless if it was their fault or not,they will share responsibility if as a professional they didn't make every effort to avoid the crash.
I know its a total bummer,but that is just the way it is in the eyes of the law.
