Each state has laws against Truck Drivers driving around with Snow & Ice build up - on top of their Trailers!

And the majority of them can be found under the regulations for littering...

Here is Massachusetts:

Massachusetts General Law - Throwing or Dropping Objects onto Public Way

Protect Yourselves this Winter!

Protect those around You!

This is an unnecessary and avoidable accident - waiting to happen!

i thought our company policy's said that it had to be removed.

Are you quoting company policy?

Do You have it in writing?

If it is policy... then it is being overlooked and ignored by management up here.

I provided this information to uphold the terms set forth in Article 15 - Section 1 & 2...

Just in case Drivers are given a choice to either drive the equipment as is... or be subject to disciplinary action... unless They are able to prove Infraction and or possible Danger to Public Safety...

Plus... Section 2 - Dangerous Conditions... requires the company to furnish a safe means of snow removal - prohibiting employee's from climbing on top of the equipment themselves...

Safe snow removal from trucks is possible

I have gone round and round with the safety department on this issue for many, many years. They only expect us drivers to have the trailer roofs cleaned off where there is a snow removal machine at your departing terminal. According to the safety department the company will not charge you with an accident if snow and ice falls off your trailer and damages property as long as there were no snow removal bars at your departing terminal. If there is, you must use it. The problem, If there is damage to property when snow and ice falls off your trailer, The police may ticket you the driver. They do not want any employee's climbing up ladders to remove snow. In the North I only know of two terminals that have a snow removal machine (steel bar) you drive under and even with that it still leaves the most dangerous stuff, A one inch layer of ice that fly's off when you hit bumps. Alternative, refuse to pull the trailer. (safety Issue)
 
We heard about a steel arch near the driveway that has a heavy-duty stiff brush attached to swipe snow and ice off. It still hasn't been installed. The local UPS Dist Ctr has this system.
 
one driver suggested to hook up and then drive around slam on break and let all the ice come forward. he only joking of course.
 
...they de-ice the planes before take off...why not de-ice the equipment before leaving the terminals...yeah right..:hysterical: .. Hrs had/has a scraper mounted on a ck bay door that would get most of the snow but that 2 inch slab of ice would always remain...

We all have seen that slab just hanging on the edge just waiting for the right pothole and watching the 4 wheelers scatter:hysterical:..or hit that unexpecting passing 4wheeler right in the windshield...

....all jokes aside what if that was your wife and kids.....

If I remember correctly does OSHA require the company to use an approved OSHA system of cleaning snow?
 
If your in DVR just drive around the building a few time, those potholes will loosen and shake off any snow or ice.

There is No longer - any need to discuss the issue!

Article 15 - Section 1. - has Specific Language - Protecting Our Decisions regarding: Equipment Condition, Safety and possible Risk to Self and or the General Public...

Section 2. - Protects Us from the Burden of Responsibility - for the Removal of Snow & Ice... Unless Proper Safety Apparatus is made available - allowing Us to be able to Remove the Snow & Ice... Without going on Top of the Equipment...

Article 15
Equipment and Safety

Section 1. Safe Equipment


The Company shall not require employees to take out on the streets or highways any vehicle that is not in a safe operating condition, including, but not limited to, equipment which is acknowledged as overweight or not equipped with the safety appliances prescribed by law. It shall not be a violation of this Agreement or basis for discipline where employees refuse to operate such equipment unless such refusal is unjustified.

It shall also not be a violation of this Agreement or considered an unjustified refusal where employees refuse to operate a vehicle when such operation constitutes a violation of any federal rules, regulations, standards, or orders applicable to commercial motor vehicle safety or health, or because of the employee’s reasonable apprehension of serious injury to himself/herself or the public due to the unsafe condition of such equipment.

Repairs to equipment will be certified on the Vehicle Condition Report.

Section 2. Dangerous Conditions

Under no circumstances will an employee be required or assigned to engage in any activity involving dangerous conditions of work, or danger to person or property or in violation of any applicable statute or court order, or in violation of government regulation relating to safety of person or equipment. The term “dangerous conditions of work” does not relate to the type of cargo hauled or handled.

Don't accept these as a possible alternative!

This Creates an Unsafe Work Environment - to Equipment, Property and Person (Snow and Ice could slide off and hit someone in the Yard, it could slide off and onto the Tractor - Blocking Visibility – and causing an Accident, Damage the Tractor - or Worst [Breaking Glass and Hitting Driver])

Plus, I believe that Most all UPSFG facilities - have a Five (5) Mile an Hour Speed Limit... in the Yard... If any of the above happen - what’s to stop the company from claiming that You were speeding and driving recklessly in the yard?
 
Here is Minnesota:

Minnesota Statute - 169.42

MISDEMEANOR

Any person violating the provisions of this section is guilty of a misdemeanor. The record of any conviction of or plea of guilty under this section of a person operating a motor vehicle shall be immediately forwarded to the Department of Public Safety for inclusion upon that offender's driving record. Any second or subsequent offense under this section shall require a minimum fine in the amount of $400. Any judge may, for any violation of this section, order the offender to pick up litter along any public highway or road for four to eight hours under the direction of the Department of Transportation, with the option of a jail sentence being imposed.

If the Snow and Ice on top of Your Vehicle flies off - and causes an Accident... Brown is going to claim that They don't even know You!

Print Out Your States - Law (I will keep adding to this thread as I find them) and put it in Your bag... this is Your Golden Ticket... We are Prohibited from Breaking the Law! (Breaking the Law - is Grounds for Immediate Termination!)

If Brown issues a Statement - claiming that They will Pay the Fine (if Ticketed)...

Ask Them if They will have the Offense Removed from Your Driving Record...

And if You have to Go to Jail - for Killing Someone... Will They Go to Jail for You (?)

And bring that Person (s) - back to Life...
