XPO drayage workers hauling out of the ports in the South have been scared to speak out. XPO Logistics, the company I worked for, used local police to attempt to block union organizing in Port Wentworth, Georgia.
But something very different happened this time.
The National Labor Relations Board decided XPO went too far and now XPO is required to post a federal notice in the workplace stating misclassified port drayage drivers – meaning we’re independent contractors in name only - have the right to form a union without intimidation.

A police bodycam video publicized by the
Huffington Post exposed what it’s really like to organize port drayage drivers in the South, where Teamster organizers were arrested outside an XPO port drayage facility in 2016 for lawful leafletting.
Our campaign to end the illegal misclassification of port drayage drivers as “independent contractors” – led by drivers like myself from the Ports of Los Angeles/Long Beach to Savannah – refuse to back down. We, along with the Teamsters, took the case to the National Labor Relations Board and won, compelling the company to post an official Board Notice effectively stating that misclassified port drayage drivers have the right to form a union and are protected under the NLRA.
Corporations cannot run and hide from their responsibility to workers under the law – no matter where they do business. We must never back down!
Every American worker – including those in the South! – has a legal right to be classified as an employee, and to a workplace free from harassment and intimidation. With one of the world’s largest – and most notoriously anti-union – logistics companies posting a notice admitting that port drayage employees in Savannah have these rights, this may be the dawn of a new day for port drivers in the South.
