Arkansas Federal Judge Rules Sleeper Berth Time Is 'Time-Worked'

"The lawsuit, filed in 2016 against P.A.M. Transport Inc., alleged that the Tontitown, Ark., motor carrier had violated the federal Fair Labor Standards Act and the Arkansas Minimum Wage Law.

The drivers alleged that for any given 24-hour shift, Department of Labor regulations prohibit P.A.M. from excluding more than eight hours from compensation for time a driver spends in a truck’s sleeper berth.

P.A.M. disagreed, claiming that it is legally permissible to exclude all time from compensation that a driver spends in a sleeper berth, regardless of whether the amount of time exceeds eight hours."

"Now the company has announced its new on-the-job training (OJT) diesel mechanic program for veterans and family members with Post 9/11 GI Bill benefits."

"Eligible applicants must qualify for Post 9/11 GI Bill benefits. As part of the OJT program, these individuals will receive a full 12 months of on-the-job training and are eligible to earn up to $1,140 per month tax-free through the GI Bill in addition to weekly Averitt pay. Benefit checks are paid directly from the Department of Veteran Affairs, typically four to six weeks after training begins. Averitt pay for the OJT program starts at $10.75 per hour and eventually hits $18.30 per hour at month 11 and $21.50 per hour after month 12."


 
FMCSA Grants Waste Management HOS Exemption

FMCSA’s exemption will allow drivers operating trucks to collect waste and recyclables to return to their starting point within 14 hours instead of 12.

"...Waste Management states in the document that ELDs “delay and distract” drivers who make frequent stops to collect trash because the devices demand interaction. The company claims that drivers who collect trash have to interact with ELDs “hundreds if not thousands of times a day.” The document also states that ELDs in trash trucks hinder safety more than they help."

i think the primary motive is to avoid the eld roll out cost just to allow their mostly local drivers to work 14 hrs.
the eld exemption rule is up to 12 hrs for local drivers, but it might be changed soon to 14 hours for local just like otr.
seems reasonable to me... deivers probably do get a lot of driving to on duty audio/visual prompts.

I'm not so much surprised W. Mgmt. asked for the exemption. I am surprised and disappointed that FMCSA granted such a nonsensical exemption. Credibility lost...
mind boggling how much $$$ to puchase peoplenet equipment across thousands of local trucks.
not to mention installation, subscription costs
all for the sake of up to 2 more on duty hours.

i dont think fedex p&d should have aobrd/eld either.
maybe the reason was bigger discount to install on more trucks and just in case road drivers need a spare.

Im pretty certain ELD’s are a federal mandate, I don’t think the company has a choice not to comply.
